We appreciate the opportunity to provide an explanation for the temporary $2 fee to your guest check. We are in unusual times with significant macroeconomic headwinds that span global supply chain shortages and ever-growing pressure from inflation. These headwinds have significantly impacted our cost of operations and our ability to operate at a high level.
Like many others in the industry it would have been easy to simply raise our menu prices, but we believe these burdens will eventually pass and as such, we elected to employ a temporary solution with the $2 fee. This fee helps us partially offset the operational cost increases and maintain the standards that our guests have come to expect. Please note that this fee is in no way affiliated with a service tip.
Surcharges have been used by government agencies, utilities, manufacturers, and retailers across industries for many years. In the past few years, restaurants, like these other businesses, have implemented surcharges successfully and lawfully. In fact, restaurant surcharges have been challenged in California state and federal courts and the courts found that restaurant surcharges are indeed lawful.
